This case involved whether a retired employee who it was claimed had been forced to seek treatment overseas should be treated in the same way as other employees and if they were due additional compensation on top of an increase in pension.

Background

An employee made a complaint against a company and requested the Labour Department to order the company to pay his dues. The department referred the case to the court.

The court ruled the company should pay the employee 24.896.759 Dinars.

The company and the employee appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the company should pay the employee 23292.79 Dinars.

The employee and the company appealed the ruling before the court of appeal.

Decision

Appeal No. 300/2004: The employee stated the ruling had violated the right of defence and had insufficient evidence of causation. It stated the company was obliged to treat an employee abroad if required according to its statute. The employee stated the court ignored his defence that he needed treatment abroad.
