KCC 288/2004

A case involved whether an employee was due his salaries from a company.

Background

An employee filed a complaint against a company before the Labour Department requesting that the department order the company to pay his salaries. The department referred the dispute to court.

The court ruled that the company pay the employee 692.308 Dinars.

The employee appealed and the appeal court held that the employee had no right to appeal the ruling.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had erred in the application of law as it was based on the value of his request not reaching 5000 Dinars, however the value of his final request did exceed this amount.

The court held that this argument was valid and repealed the ruling.
