Insurance – Personal Injury – Employer’s Liability – Inheritance – Workplace Injury – Blood Money
This case involved a claim for blood money by the heirs of an employee who had died at work. The insurance company which had been added to the case wrongly tried to claim they were not liable because this accident had not happened while the employee was at work or as a result of their work. The accident had happened while the employee was travelling from work to home so it counted as being while they were at work.
Background
The heirs of employee made a complaint against a company and requested the Labour Department order the company to pay them blood money as compensation for the death of their father at work. The department referred the case to the court.
The heirs added an insurance company to the case and requested the court to order it to pay the compensation along with the company.
The court rejected the case.
The heirs appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the company should pay the heirs 10000 Dinars.
