Payment of Salaries – Expert Report – Court Authority
A case involved a dispute between an employee and an employer over the payment of his salaries.
Background
An employee filed a case against an employer requesting that the court order the employer to pay his salaries.
The court rejected the case.
The employee appealed and the appeal court ruled that the employer pay the employee 1622.139 Dinars.
The employer appealed by cassation.
Decision
Before the cassation court the employer argued that the ruling had erred in the application of law as the court failed to consider an expert report which concluded that the employee only deserved 180 Dinars.
The court held that this argument was invalid as the expert's report is only one component of the evidence in a case which falls completely under the discretionary authority of the court.
The court therefore dismissed the appeal.
