KCC 144/2005

This case involved a claim by an insurance company for the repayment of money it had paid to a third party who had been injured by an employee of the company. Although there was an insurance policy, the company was liable to pay for damage caused by illegal acts of their employees.

Background

An insurance company filed a case against two companies and requested the court to order them to pay an amount of money. The insurance company stated it had paid compensation to a person who was injured by a person who belonged to the first company and that the first company had insured its employees through the second company.

The court ruled that the first company should pay the insurance company 54720 Dinars.

The insurance company and the first company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
