KCC 1182/2004

This case involved a claim for a debt to be made. Litigation had been taken out against the defendants' mother who was the owner of the company which owed the money. She had died during the litigation and the case was taken against her heirs. The heirs' liability to pay the value of a debt should be limited to the value of their inheritance.

Background

A claimant filed a case against defendants and company and requested the court to appoint an expert in order to make a final settlement between the two parties and order the defendants to pay accordingly.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled that the defendants should pay the claimant 5610 Dinars.
