Litigation Procedure – Statute of Limitations – Severance Pay – Employment Contract – Termination of Employment – War
This case involved a claim for severance pay by an employee during the period of the Iraqi invasion. A key issue was whether the statute of limitations applied. It did not as the case had been filed one year before the employment contract ended.
Background
A claimant filed a case against a defendant and requested the court appoint an expert in order to calculate his dues and the severance pay for the period of the Iraqi occupation of Kuwait.
The court appointed an expert and then ruled that the defendant should pay the claimant 10733.301 Dinars.
The claimant and the defendant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.
