KCC 1097/2004
Background
An employee filed a case against defendants and requested the court to order the first defendant to pay their labour dues.
The court stated it had no mandate to consider the case on the compensation request and referred the request to the commercial department and rejected other requests.
The employee appealed the ruling before the court of appeal. The court stated the employee had no right to appeal the ruling.
Decision
The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application because the elementary court stated it had no mandate to consider some requests but it had issued an absolute ruling on other requests which meant that the employee had the right to appeal the ruling in this part.
