Background
The heirs of an employee filed a case against a company requesting that the court order the company to pay compensation for the death of their father.
The court ruled that the company pay the heirs 15750 Dinars.
The heirs and the company appealed and the appeal court ruled that the company pay the heirs 10000 Dinars.
The company appealed by cassation.
Decision
Before the cassation court the company argued that the appeal court's ruling had insufficient evidence of causation as the previous ruling had no legal power against it as the company was not a party in the case.
The court held that this argument was invalid as regardless of the previous ruling, the lower court's ruling concluded that there was a working relationship between the employee and the company and the employee had died during the course of his work for the company.
The court therefore dismissed the appeal.
