KCC 824/2001

The original dispute involved a salary claim by an employee who had worked for a company, left and re-joined it against her employers. The dispute was originally heard by a Grievance Committee and one of the issues was which court had jurisdiction to hear the appeal. In question was whether the appeal court had taken into account appropriate evidence in coming to its decision. The case should not have been brought before the Court of Cassation as the lower court had the authority to understand the case and assess the material evidence.

Background

An employee filed a case (551/2000) at the Kuwait Administration Court against both the social security company and the company she worked for claiming a decision by the Grievance Committee which had refused her request to be entitled to an initial salary of 2000 Kuwaiti Dinar should be cancelled.
