This case involved a request for a tenancy agreement to be dismissed, late rent be paid and the tenant evicted. It was wrongly claimed the case should be dismissed because the claimant had sold the property while the case was under consideration. This was irrelevant as it had not been argued until the Court of Cassation.
Background
A company filed a case against a company and requested the court to dismiss a tenancy agreement and order the company to vacate the rented property, pay late rent and dismiss a tenancy agreement dated on 01/01/1981.
The court ruled that the two tenancy agreements should be dismissed and the company should vacate the rented property and pay the late rent.
The company (defendant) appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that only of the two tenancy agreements which related to a hotel should be dismissed.
