KCC 759/2003

This case involved a claim by an employee for severance pay. It was wrongly argued by the company the court had been wrong to rule severance pay be paid. However, the court had correctly applied civil service rules and conditions of a first contract.

Background

An employee filed a case against a company and requested the court to order the company to pay him severance pay.

The court ruled that the company should pay the employee 6932.795 Dinars.

The employee and the company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law because the court had ruled that the company should pay the employee severance pay in violation to the relevant laws.

The court stated this argument was invalid because the court had applied the rules of Kuwait Decision No. 6/1979 on the civil service and had applied the conditions of the first contract signed with the employee.

The court dismissed the appeal.
