KCC 676/2003

This case involved a claim for compensation as a result of administrative decisions which had been issued. The court had wrongly based their decision on the fact the claimant's degree documents were forgeries, so she was responsible for the mistake. This was incorrect as the Public Prosecution had found them to be genuine.

Background

A claimant filed a case against a defendant and requested the court to order the defendant to pay 30000 Dinars compensation for damage which had resulted from the administrative decisions made by the defendant.

The defendant filed a case against the claimant and requested the court to order the claimant to pay amount of money.

The court rejected the two cases.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The claimant appealed the ruling before the court of cassation and stated in their grounds of appeal that the ruling had erred in the application of law because the court had established its ruling based on the argument that her degree document was fabricated and concluded she was responsible for the mistake made by the administrative body.
