KCC 60/2004

A case involved a dispute between an employee and two companies over the payment of compensation for a work injury.

Background

An employee filed a case against two companies requesting that the court order them to pay him compensation for a work injury.

The first company filed a case against the second company requesting that the court order it to pay the value of compensation.

The court ruled that the first company pay the employee 42764.366 Dinars and that the second company pay this amount to the first company.

Both companies appealed and the appeal court upheld the ruling regards the first company and abandoned the ruling regards the second company.

The first company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had erred in the application of law as the appeal court had abandoned the ruling regards the second company for reasons the second company had not detailed in its appeal document.

The court held that this argument was valid and repealed the ruling.
