KCC 578/2003

A case involved a dispute between an employee and two companies over the payment of her salaries.

Background

An employee filed a case against two companies requesting that the court order the first company to pay her an amount of money plus legal interest. The employee stated that she used to work with the second company and had been dismissed from her job due to medical reasons. The employee stated that the second company insured her through the first company.

The court rejected the case.

The employee appealed and the appeal court ruled that the first company pay the employee an amount of money plus legal interest at 7%.

The first company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had erred in the application of law as it had argued before the court that the case should not be considered for being previously settled but the court rejected this argument based on the company not being represented in the case when it was.
