A case involved whether an employee was due his salary amounts from an association.

Background

An employee made a complaint against an association before the Labour Department requesting that the department order the association to pay his salaries.

The court ruled that the chief of the board of directors of the association pay the employee 538.002 Dinars.

The employee appealed and the appeal court ruled that the chief pay the employee 5521.062 Dinars.

The employee and the chief appealed by cassation.

Decision

Appeal No. 72/2004

The chief argued that the ruling had insufficient evidence of causation as the court had adopted the conclusions of an expert report and ignored his objections to these conclusions.

The court held that this argument was invalid as Article 153 of the Kuwait Pleadings Law, Kuwait Law No. 38/1980 stipulates that the appeal document should accurately include the reasons for appeal and the faults in the ruling.

The court therefore dismissed the appeal.
