KCC 53/2003, 55/2003

A case involved a dispute between an employee and a company over the payment of his salaries and compensation for a work injury.

Background

An employee filed a case against a company requesting that the court order it to pay his salaries and compensation for a work injury.

The company filed a case against the employee requesting that the court order him to pay the remaining value of a loan. The company also filed a case against an insurance company requesting that the court order it to pay the value of compensation.

The court ruled that the company pay the employee 14498.715 Dinars and the insurance company pay the company 12500 Dinars.

The insurance company and company appealed and the appeal court upheld the ruling.

The insurance company and company appealed by cassation.

Decision

Appeal No. 55/2003

Before the cassation court the company argued that the ruling had erred in the application of law as the court had included the value of allowance at 100 Dinars in the wage of the employee, however, this was a one-time payment and not a fixed allowance.
