Background

An employee filed a case against a company requesting that the court order it to pay his salaries and compensation for a work injury.

The court ruled that the company pay the employee 39.153 Dinars.

The employee appealed and the appeal court ruled that the company pay 2358.384 Dinars.

The company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had contradicted material documentary evidence as the court ruled that the company pay compensation and did not suspend the consideration of the case until a penal ruling had been settled.

The court held that this argument was invalid as the court had ordered the company to pay the value of compensation in accordance with Article 65 of Kuwait Law No. 38/1964.

The court therefore dismissed the appeal.
