KCC 415/2001
Background
A claimant filed a case against a defendant and requested the court to appoint a medical committee in order to determine the rate of disability which had resulted from an injury he got during the demolition of a fence at a home owned by the defendant.
The court rejected the case.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The claimant appealed the ruling before the court of cassation.
Decision
The court repealed the ruling and appointed a doctor to view the case.
The court then stated the claimant had requested the court to appoint a doctor to determine their rate of disability as a result from the injury and the court had done so.
Therefore, the court stated the case was completed.
