KCC 362/2003

This case involved a claim by an employee for compensation from an insurance company for an injury he had sustained on his way to work. The insurance company argued the insurance contract did not cover pay for sick leave. However, the insurance company had not clearly explained its appeal reasons.

Background

Decision

The insurance company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had insufficient evidence of causation because the claimant had requested compensation for the period of treatment in the hospital although the insurance document stipulated compensation should not be paid for sick leave.
