Background
A claimant filed a case against a company and requested the court to order the company to pay him 5001 Dinars in compensation for a workplace injury.
The court ruled that the company should pay the claimant 5000 Dinars.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law and the case related to a workplace injury and so the labour court should consider it and the employee should make a complaint before the labour department before filing the case.
The court stated this argument was invalid because it was a claim compensation for injury and so falls under the rules of liability of tort.
The court dismissed the appeal.
