Decision

Before the cassation court the institution argued that the ruling had erred in the application of law as the claimant had determined his requests in the case, but failed to pay the fees for these requests and thus the court should have rejected his appeal under Article 22 of Kuwait Law No. 171/1973.

The court stated that this argument was invalid as the financial violation made by the claimant did not entail the dismissal of the appeal.

The court therefore dismissed the appeal.
