Background
A claimant filed a case against a defendant requesting that the court dismiss a decision and make a settlement as to his occupational status under a Civil Service Council decision.
The court ruled that the defendant make the mentioned settlement and pay the claimant his dues accordingly.
The defendant appealed and the appeal court abandoned the ruling and rejected the case.
The claimant appealed by cassation.
Decision
Before the cassation court the claimant argued that the ruling had erred in the application of law as there was no justification given for distinguishing between an American medical degree and a non-American medical degree.
The court held that this argument was invalid as the court cannot establish its ruling on a wrong decision and consider this as legal basis for another wrong decision.
The court therefore dismissed the appeal.
