KCC 252/2003

This case involved a claim for compensation by an individual who had been injured after being assaulted. The case was referred to the General Department for Criminal Evidence and it was concluded the individual's condition was stable and they had a sustained injury.

Background

A claimant filed a case against a defendant and requested the court to order the defendant to pay him 5001 Dinars as compensation for an injury that had resulted from the defendant's assault on him.

The court ruled that the defendant should pay the claimant 4000 Dinars.

The defendant appealed the ruling before the court of appeal. The court dismissed the appeal.

Decision

The defendant appealed the ruling before the court of cassation.

The court of cassation repealed the ruling and referred the case to the General Department for Criminal Evidence.

The department provided the court with a medical report which concluded that the medical condition of the claimant was stable and that he suffered problems in his left shoulder.

The court stated it was persuaded by the report.

The court upheld the appealed ruling.
