Background

The court of cassation repealed the ruling and referred the case to the General Department for Criminal Evidence.

The department provided the court with a medical report which concluded that the medical condition of the claimant was stable and that he suffered problems in his left shoulder.

The court stated it was persuaded by the report.

The court upheld the appealed ruling.
