KCC 177/2003

A case involved a dispute between a claimant and defendant over the payment of his allowances and retirement salary.

Background

A claimant filed a case against a defendant requesting that the court order it to pay his allowances and retirement salary.

The court rejected the case.

The claimant appealed and the appeal court upheld the ruling.

The claimant appealed by cassation.

Decision

Before the cassation court the claimant argued that the ruling had erred in the application of law as the court had rejected his case based on him failing to make a plea within the legal deadline, but he had made a plea and filed the case within the deadline stipulated by Article 107 of the Kuwait Social Security Law, Kuwait Law No. 61/1976.

The court held that this argument was invalid as the case documents revealed that the claimant had not made his plea within the deadline stipulated by Article 107 of the same law.

The court therefore dismissed the appeal.
