Background

The heirs of a deceased employee brought a claim against a company requesting that the court order the company to pay their father's salaries.

The heirs filed a case against an insurance company requesting that the court order both companies to pay the mentioned amount.

The court ruled that the insurance company pay the heirs 10000 Dinars in blood money.

The insurance company appealed and the appeal court upheld the ruling.

The insurance company appealed by cassation.

Decision

Before the cassation court the insurance company argued that the ruling had erred in the application of law and had insufficient evidence of causation as the court had ordered it to pay the mentioned amount in violation of the insurance document.

The court held that this argument was valid as the insurance documents did not stipulate that the heirs of the employee or any third party could claim the value of insurance in case of damage.

The court therefore repealed the ruling.
