Background
An employee filed a case against a company requesting that the court order it to pay the value of overtime hours.
The court rejected the case.
The employee appealed and the appeal court upheld the ruling.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had violated the law and contradicted material documentary evidence as the court had rejected the case based on there being no proof that he had worked overtime hours, but he had remained in his work location for emergency cases during these hours.
The court held that this argument was invalid as the employee failed to prove that he was assigned by his employer to work the mentioned hours.
The court therefore dismissed the appeal.
