KCC 155/2002

This case involved a claim by an employee for their dues. It was irrelevant whether the employee accepted the expert report as it was the court had authority to assess it and if it felt it was sufficient need not refer the case to investigation.

Decision

The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had insufficient evidence of causation because the court had established its ruling based on the expert report although he objected to the conclusions of this report. The employee also stated the court had rejected his request to refer the case to investigation in order to prove his claims that a working relationship existed between the two parties.
