Background
An employee made a complaint against a bank and requested the Labour Department to order the bank to pay his dues. The department referred the case to the court.
The court ruled that the bank should pay the employee 12204.386 Dinars.
The bank appealed the ruling before the court of appeal. The bank upheld the appealed ruling.
The bank appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law because the court had refused to order the bank to pay two-months pay in lieu of notice based on the argument that the contract had a definite period although it is acceptable for the two parties to agree the party who terminates the contract should pay compensation.
