KCC 830/2002

This case involved a claim by an employee that they should be paid the same salary as they had been in a previous post at the Ministry of Health. It was wrongly argued the court had been incorrect to treat this as a settlement case as it was a cancellation case with a different deadline. This argument was rejected as it was brought for the first time at the Court of Cassation.

Background

A claimant filed a case against defendants and requested the court to order the second defendant to pay him the same salary he used to receive when he was working in the Ministry of Health.

The court ruled the claimant had the right to receive the same salary that he used to receive in the previous position.

The defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
