KCC 81/2002

A case involved a dispute between an employee and a company over the payment of her salaries.

Background

An employee filed a case against a company requesting that the court order it to pay her salaries.

The court ruled that the company pay the employee 4421.472 Dinars.

The employee appealed and the appeal court ruled that the employee had no right to appeal the ruling.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had erred in the application of law as the court ruled that the employee had no right to appeal the ruling due to the lack of quorum, however it had maintained before the court that the elementary ruling was illegal.

The court held that this argument was invalid as the legislator permits the appealing of a ruling before the appeal court in specific cases stipulated by Article 138 of the Kuwait Pleadings Law.

The court therefore dismissed the appeal.
