KCC 74/2002

A case involved a dispute between an employee and a company over the payment of his salaries and compensation for a work injury.

Background

An employee filed a case against a company requesting that the court order it to pay his salaries and compensation for a work injury.

The court ruled that the company pay the employee 3112.716 Dinars.

The employee appealed and the appeal court held that the employee had no right to appeal due to the lack of quorum.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had erred in the application of law as he had requested that the court correct a mistake in the expert's report which meant that his claim value exceeded the final quorum of the court.

The court held that this argument was valid as the employee had requested that the court correct the mistake in the expert's report as the disability rate resulting from his injury was 25%, therefore, this exceed the final quorum of the court.

The court therefore repealed the ruling.
