KCC 688/2002

A case involved a dispute between a claimant and defendants over the dismissal of a decision which had deprived her from promotion.

Background

A claimant filed a case against two defendants requesting that the court order the defendants to dismiss a decision which had deprived her from promotion and pay compensation.

The court ruled that the decision be dismissed.

The defendants appealed and the appeal court upheld the ruling

The defendants appealed by cassation.

Decision

The defendants argued that the ruling had erred in the application of law as they had argued that the court had no mandate to consider the case as the mentioned decision was not an administrative one, therefore, the case should not have been considered by the administrative court.

The court held that this argument was invalid as the court has the authority to consider all aspects of a case and evaluate the evidence in order to establish its ruling.

The court therefore dismissed the appeal.
