Promotion to Grade 26 - Training – Proving of Claim
A case involved a dispute between an employee and a company over a promotion.
Background
An employee filed a case against a company requesting that the court order it to promote him to Grade 26.
The court ruled that the company promote the employee and pay him 7958.25 Dinars.
The company appealed and the appeal court upheld the ruling.
The company appealed by cassation.
Decision
Before the cassation court the company argued that the ruling had erred in the application of law as the employee had not been trained for the promotion but the court ignored this argument.
The court held that this argument was invalid as the company had failed to prove its claims that the employee required training before promotion.
The court therefore dismissed the appeal.
