Background

A claimant filed a case against defendants requesting that the court order them to pay an amount of money plus legal interest. The claimant stated that the defendants had failed to commit to their obligations under contract.

Decision

Before the cassation court the defendant argued that the ruling had insufficient evidence of causation as the court had established its ruling on an expert report which included many faults.

The court held that this argument was invalid as the court has the authority to consider all aspects of a case and evaluate the evidence in order to establish its ruling. The court stated that it was persuaded by the expert's conclusions.

The court therefore dismissed the appeal.
