KCC 607/2001

A case involved a dispute between a claimant and a company over compensation for damage.

Background

A claimant filed a case against a company before the arbitration committee of the Kuwait Financial Market requesting that it order the company to pay compensation for damage resulting from a decrease in share prices.

The committee ruled that the company pay the claimant 2640 Dinars.

The company appealed by cassation.

Decision

The Public Prosecution argued that the company had no right to appeal the decision.

The court held that this argument was valid as Article 152 of the Kuwait Pleadings Law, Kuwait Law No. 38/1980 stipulates that the appeal before the court of cassation should be only made against the ruling issued by the court of appeal. The court stated that the appealed ruling was not one of the rulings that the mentioned article accepted as an appeal.

The court therefore dismissed the appeal.
