Background

A claimant, as trustee to her sons, filed a case against defendants requesting that the court order them to pay compensation for the death of the sons' father in a working accident.

The first defendant added a fourth defendant to the case.

The court rejected the adding of the fourth defendant and ruled that the third defendant pay the claimant 10000 Dinars and the first and second defendants pay the claimant 4000 Dinars.

The claimant and defendants appealed and the appeal court rejected the case against the third defendant and ruled that the first and second defendants pay the claimants 9000 Dinars.

Decision

The court dismissed the appeal made by the first defendant stating that a penal ruling had been issued against him and thus he should bear the responsibility for the accident and pay compensation.
