KCC 480/2002

This case involved a claim by an individual for money and unpaid rent. The key issue was what was the position when the claimant had requested rent for one period but the court had ordered rent for a different period be paid.

Background

A claimant filed a case against a company and requested the court to order the company to pay him an amount of money and rent.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the company should pay the claimant 144000 Dinars in addition to 36000 Dinars.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had violated the law and stated that the court had ordered it to pay the rent for the period from 1997 to 2000 although the claimant had requested rent for the period from 1998 to 2001.
