KCC 35/2002

A case involved a dispute between an employee and a company over the payment of his salaries.

Background

An employee filed a case against a company requesting that the court order it to pay his salaries.

The court ruled that the company pay the employee 1412.300 Dinars.

The company appealed and the appeal court ruled abandoned the ruling and rejected the case.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had erred in the application of law as the court had established its ruling on a final settlement he had endorsed which stated that he had received all his dues. However, he had maintained before the court that he was forced to sign this document at the time his employment commenced.

The court held that this argument was invalid as the court expert had concluded that the employee signed the settlement and failed to prove his claims.

The court therefore dismissed the appeal.
