KCC 355/2002
Background
A claimant filed a case against defendants and requested the court to suspend the implementation of the generalization which had been issued by the general manager of traffic police and decision No. 8/2000 until the case No. 477 was settled.
The court ruled rejected the requests made by the claimant.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The claimant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law. It was stated the court had rejected his request for the cancellation of ministerial decision No. 421 based on the argument that the deadline had passed although this decision was a public one which can be appealed without deadline restrictions.
The court stated this argument was valid because decision was a public one that can be appealed without deadline restrictions.
