KCC 305/2002
A claimant filed a case against a defendant and requested the court to dismiss the decision deducting salary she had received during the Iraqi invasion of Kuwait.
The court rejected the case.
The claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled that the mentioned decision should be dismissed.
Decision
The defendant appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had insufficient evidence of causation because he had maintained before the court that the right of the claimant to claim the amount of money should be dismissed due to the statute of limitation.
The court stated this argument was valid because the request of the claimant fell under the statute of limitation stipulated by Article 21 of Kuwait Law No. 15/1979.
The court repealed the ruling.
