KCC 296/2002

This case involved a claim by the heirs of an individual who had been killed by an unknown person. The court had wrongly assumed this was a workplace accident but it had not happened or been connected to his work, so the state was liable to pay the heirs compensation.

Background

The claimants filed a case against a defendant and requested the court to order the defendant to pay blood money. The claimants stated their father had been killed by an unknown person.

The court ruled that the defendant should pay the claimants 10000 Dinars.

The defendant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.

Decision

The claimants appealed the ruling before the court of cassation and stated in their grounds of appeal that the ruling had erred in the application of law and stated the court had rejected the case based on the argument that their father was killed at work and as a result of it and so did not deserve compensation from the state although the investigation had revealed that the death of their father was not related to his work.
