Background

A claimant filed a case against a defendant and requested the defendant to pay him money as compensation for their legal dismissal from his job.

The court ruled that the defendant should pay the claimant 1845 Dinars.

The defendant and the claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.

Decision

The claimant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and said the court had not applied the conditions of the agreed contract and the rules of Kuwait Law No. 15/1979 over the case.

The court stated this argument was invalid because the court had established its argument based on the fact that the claimant's contract was renewed after he had reached retirement age and so the claimant did not deserve compensation for his dismissal.

The court dismissed the appeal.
