This case involved a claim by a director that he had been improperly dismissed as a director and a new board had been appointed without holding the relevant meeting. This was incorrect the correct procedures for dismissing a director and appointing a new board had been followed.
Background
A claimant filed a case against the defendants and requested the court to suspend an invitation to convene the board of directors of the company he represented and dismiss a decision made by the Minister of Commerce to recompose the board of directors.
A defendant intervened in the case and requested the court reject the case because it had been filed against irrelevant party.
The court rejected the case and the intervention.
The claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling regarding the rejection of the case.
