Decision

Before the cassation court the claimant argued that the ruling had insufficient evidence of causation as the court had established its ruling upon an expert report, but he objected to the conclusions of the report as the case documents included no proof that he had taken over the disputed restaurant.

The court stated that this argument was invalid as the court has the authority to consider all aspects of a case and evaluate the evidence before it to establish its ruling.

The court therefore dismissed the appeal.
