KCC 123/2002
Background
An employee filed a case against a company requesting that the court order it to pay him compensation for a work injury.
The court rejected the case.
The employee appealed and the appeal court held that the employee had no right to appeal.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had erred in the application of law as the court had rejected the case based on there being no working relationship between the employee and the company, but the company had not denied the existence of such a relationship.
The court held that this argument was invalid as the appeal had been filed against the elementary ruling and not the appeal court ruling.
The court therefore dismissed the appeal.
