Background
An employee made a complaint to the department of labour against a bank. He said that he was working for the bank and that he was dismissed from his job without justification. He requested the bank to pay his entitlements. The department referred the case to the court.
The court dismissed the case.
The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The employee appealed the ruling before the court of cassation.
Decision
The court of cassation considered the issues which related to the public order. The court said that Article 153 of Kuwait Decree-Law No. 38/1980 stipulated that the appeal document should include the details of the ruling and its date and the names of the disputed parties. The court said that the documents of the case revealed that the appeal document introduced by the employee lacked the basic details about the ruling against which the appeal was made.
The court dismissed the appeal.
