Background

An employee filed a case against a company requesting that the court order it to pay his salaries.

The court ruled that the company pay the employee 11690262 Dinars.

The employee appealed and the appeal court upheld the ruling.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had contradicted material documentary evidence as he had maintained before the court that he deserved 5000 Dinars in compensation for damage resulting from the withholding of his passport, but the court ruled that he only deserved 180 Dinars.

The court held that this argument was invalid as the estimation of compensation falls under the authority of the court and the amount awarded was enough to compensate for the damage.

The court therefore dismissed the appeal.
