This case involved a maintenance claim by a wife for her children. The wife should receive money for the children because they were living with her.
Background
A wife filed a case against her husband before the court. She requested the court to order the husband to pay her expenses and the expenses of her children. She said that the husband had failed to pay these expenses though a final ruling was issued in this regard.
The court dismissed the case.
The wife appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the husband should pay the wife 160 Dinars per month.
The husband appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had insufficient evidence of causation. He said that the court established its ruling on the grounds that the children admitted that they live with their mother though they did not admit that their father did not pay their expenses.
