KCC 82/2002
This case involved what should be paid based on blame in a divorce case under Lebanese law.
Background
A wife filed a case against a husband before the court. She requested the court to divorce her from her husband. She said that her husband used to insult and beat her.
The court ruled that the wife should get divorced and that the husband should pay half of her entitlements.
The wife and the husband appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the husband should pay all the wife's entitlements.
The husband appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. He said that the court concluded that the mistreatment was a joint action from both parties and therefore the court should not have ordered him to pay the wife's entitlements .
